These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Lumi Studio regarding your access to and use of the Lumi mobile application and related services (collectively, the "Services").
By downloading, installing, accessing, or using the Services, you agree that you have read, understood, and accept to be bound by all of these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY STOP USING THE SERVICES AND UNINSTALL THE APPLICATION.
1. Description of Services
Lumi provides users with advanced AI-powered video creation tools, image-to-video generation, trending motion templates, and video quality enhancement features. The Services allow users to upload media files, apply AI filters and effects, and export high-definition video content.
2. Eligibility & Age Restriction
You must be at least 13 years old (or 16 in certain jurisdictions) to use the Services. If you are under the age of majority in your jurisdiction, you must have the consent of your parent or legal guardian to agree to these Terms and use the Services.
3. User Content & Intellectual Property
A. Your Content
- You retain full ownership and intellectual property rights in any photos, videos, or assets ("User Content") you upload to the Services.
- By submitting User Content, you grant Lumi Studio a non-exclusive, worldwide, royalty-free, limited license to host, process, and render such content solely for the purpose of providing the Services to you.
- You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to submit the User Content, and that your User Content does not infringe upon any third party’s intellectual property, privacy, or publicity rights.
B. Lumi Intellectual Property
- All software, algorithms, interfaces, graphics, templates, branding, trademarks, logos, and audio-visual assets provided within the Services are the exclusive property of Lumi Studio or its licensors.
- You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial purposes.
4. Prohibited Uses
When using our Services, you agree not to:
- Upload, generate, or share any content that is illegal, defamatory, harmful, sexually explicit, abusive, harassing, or promotes hate speech or violence.
- Upload images or media of individuals without their explicit consent or create non-consensual deepfakes.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code or underlying models of the App.
- Use automated bots, scrapers, or exploits to access, manipulate, or overburden the Services or bypass credit limitations.
- Infringe upon or violate the copyright, trademark, privacy, or intellectual property rights of any third party.
5. In-App Purchases, Credits, and Subscriptions
- Credits (Consumables): Certain premium features require credits to generate content. Credits purchased within the app are consumable virtual items. Credits have no cash value and cannot be transferred or redeemed for legal currency.
- Subscriptions (Auto-Renewing): Subscriptions (such as Weekly VIP with Free Trial or Annual VIP) provide ongoing access to premium templates and features. Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current billing cycle.
- Billing & Management: All payments, recurring charges, and cancellations are processed through Google Play Billing (or Apple App Store on iOS). You can manage or cancel your subscription at any time via your Google Play account settings.
- Refunds: Refund requests are subject to the standard policies of Google Play Store (or Apple App Store).
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. LUMI STUDIO DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR DEFECTS. AI GENERATION RESULTS MAY VARY, AND WE DO NOT GUARANTEE SPECIFIC OUTCOMES OR ACCURACY.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMI STUDIO, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICES.
8. Termination
We reserve the right to suspend or terminate your access to the Services at any time without prior notice if you violate any provision of these Terms or engage in conduct that harms the integrity of the platform or other users.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles.
